Child Maintenance

Has a bailiff visited you to collect Child Maintenance Payments? This guide can help.


Missed child maintenance payments could attract bailiff action.  If you miss payments the CMS (Child Maintenance Service) will refer this to the CSA (Child Support Agency).  They will ask the magistrates court to issue a liability order for the missed maintenance payment.

Once a liability order has been issued by the magistrates court, a bailiff can be instructed to recover the debt.

A county court can also take different types of action against the debtor.  The court can ask an individual or business to freeze money owed to the debtor, they can also ask a bank, post office of building society to freeze the accounts of the debtor.

The CSA (Child Support Agency) can register a charging order on land, stocks, shares, interests or trust funds.  Money owed will be deducted from the sale of these things.

The CSA can also apply to the courts to force the debto to sell their property to pay the money they owe.
