Bailiffs are not allowed to take from you belongings that are used in your trade or business.
There are certain protected items that bailiffs are not allowed to take. This article focuses specifically on belongings that are used in your trade or business to earn your money.
The basic principle is that the bailiff should not take anything away from you that enables you to earn the money needed to repay your debts.
These items could include things like:
- A trade vehicle. Perhaps a van or car that is used by you for work.
- Tools used for study such as books, a computer or test equipment.
- Tools necessary for work such as powertools.
If the total value of these items exceeds £1350 then the bailiff can start to take control of goods whether they are used for trade or not.
If the bailiff is collecting unpaid business rates they are allowed to take control of your belongings whether they are used for trade or not.
